Alexfineart Ltd is committed to protecting the privacy and security of your personal data.

This privacy policy provides you with information on how we collect and store personal data, process and dispose of that data. It will also explain which third parties are provided with that data in order to fulfil our legal obligations to you regarding your online order. Your rights are explained regarding your personal information that you provide us. Alexfineart Ltd is the data controller of the personal data of our website visitors.

This privacy policy applies to personal information about individuals. It does not apply to information we hold about companies.

HOW WE COLLECT THE PERSONAL INFORMATION

Most of the personal information we process is provided to us directly by you through:

·       direct contact on our website contact form, email and phone.

·       placing an order on our website.

·       offline contact via email or phone (consumer and business).

·       engaging with our social media posts.

We also receive personal information indirectly, from the following sources:

·       When you visit our website we may collect data about the browser you are using. We use tracking tools to collect internet and usage information from visitors to our site. This might include your IP address and the URL from which you were referred. It also records your general location (country and city). This information will include the pages you view on our site during your visit.

 

WHY WE HAVE IT AND WHAT WE USE THE DATA FOR

·       To reply to your direct contact by email or phone.

·       To process online orders.

·       To answer a query regarding a past order or process a refund.

·       To fulfil an order for artwork purchased offline (consumer and business).

·       To engage with businesses on projects supplying bespoke and customised artwork.

 

PROCESSING DATA

Under General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:

(a)     Your consent. When you submit an online form with your name and email address you consent to us replying to you using those contact details. You are able to remove your consent at any time. You can do this in writing by contacting Alex Holland on info@alexfineart.com.

(b)     We have a contractual obligation. When you make an order with us through the website or directly through other communication means, we have a contractual obligation to fulfil your order and send the goods to you. We require your name and address to enable us to fulfil the delivery and we will pass this information to selected third party suppliers in order to fulfil the order.

(c)     We have a legal obligation. In the event of fraudulent or criminal activity we may need to obtain and process your data. If our accounts are audited by HMRC Inspectors, sales history will need to be made available. If we have been asked to provide information for legal or regulatory purposes, we may share information with a government agency or regulatory authority that requests it.

 

SHARING DATA

We may share personal data with third parties only for the provision of fulfilling orders (online and offline) and accounting. These companies include Metro Imaging Ltd (printers of photographs), Kay Mounting (diasec producers), Royal Mail, UPS and other couriers (including John Harper Delivers for London deliveries), Stripe and PayPal (for payment processing) and Squarespace (website host that manages the checkout process). Personal data may be shared with additional third parties who we may select to fulfil your order and only for the purpose of fulfilling your order.

Invoices and receipts with name and address may be made available to Hilton Consulting for the purpose of accounting and bookkeeping only. No details will be retained by the accountants. Any third parties to whom we supply your data to are obliged to use it solely for the purpose it was intended, to process it securely and to destroy it once it is no longer required.

If you provide us with a third party’s personal data (e.g. arranging delivery to another person as a gift), you confirm to us that you have their permission to do so and that they are aware of the contents of this privacy policy and do not have any objection to our processing their data in accordance with this policy.

We do not sell or rent your personal data to third parties.

 

RETENTION

We will keep your personal data related to sales for a period of at least six years to comply with government tax requirements. We store your data on paper records (invoices and receipts record your name and address only), and online systems, including email servers which store email communications and order forms, which are password protected. No payment information is stored or transmitted directly to us. It is managed by third party platforms including Stripe and PayPal. Emails with personal data will be deleted from email servers after a period of ten years and paper records destroyed after a period of ten years. All paper records with personal data are shredded thoroughly.

Under data protection law, you have the following rights:

Your right of access You have the right to ask us for copies of your personal information.

Your right to rectification You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. If your personal information changes, please email info@alexfineart.com to update your information.

Your right to erasure You have the right to ask us to erase your personal information if you believe we do not have a right to hold onto that information.

Your right to restriction of processing You have the right to ask us to restrict the processing of your personal information.

Your right to object to processing You have the right to object to the processing of your personal information.

Your right to data portability You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in a commonly used and machine readable format.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Personal data can only be transferred to the person to whom it refers. Our website is hosted by Squarespace which is also our website analytics provider. Squarespace collects personal data when you visit our site, and to power Squarespace Analytics, which is a platform that gives us insight into how our site is performing. The following data is collected:

Squarespace needs this data to run our website, and to protect and improve its platform and services. Squarespace analyses the data in a de-personalised form. This information may also include details about your use of this website, including:

We share this information with Squarespace to learn about site traffic and activity. Information is transmitted and stored by Squarespace in the United States.

There are also analytics and performance cookies which are only used once permission is obtained through acknowledging the cookie banner. PRIVACY SHIELD AND INTERNATIONAL TRANSFERS

Squarespace, our website host, is self-certified to the EU-US and Swiss-US Privacy Shield, which allows Squarespace to lawfully transfer EU and Swiss personal data to the US, including their US-based data centres.

 

ONLINE CUSTOMERS

When you buy something on our website, we collect personal information from you to fulfil your order. We may collect information including:

We share this information with Squarespace, our online store hosting provider, so that they can provide website services to us. As you proceed to checkout, this site may auto-complete your shipping and billing address by sharing what you type with Google Places API and returning suggestions to you to improve your checkout experience. We may email you with messages about your order. For example, we may email you to tell you that:

·       Your order has shipped

It is not possible to unsubscribe from these messages. We share your contact information with Squarespace, our website hosting provider, so they can send these emails to you on our behalf.

 

PAYMENTS

We provide paid products on our website. We use third party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third party payment processors whose use of your personal information is governed by their privacy policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. The payment processors we work with are:

We take reasonable preventative steps; however, Alexfineart Ltd does not accept liability for any virus that might be contained within it.
